Partner imigration Australia

DOCUMENTS REQUIRED: The following is a list of documents that must be submitted in support of a Partner Migration visa application. This list specifies the minimum documentation only and is not exhaustive. It is open to applicants to submit any documentation they wish which they believe will assist in the assessment of their application.


Consent to Obtain Personal Information, signed and dated by the applicant. Please refer to attachment.

Documents relating to the Applicant(s):
Four passport size photographs (4cm x 6cm) of each applicant. Photographs must not be more than 6 months old
Certified copies of each applicant’s passport or travel documents, if any
Certified copies of all pages of current Household Registration Book
Certified copies of Birth Certificate(s) for each applicant
Original Curriculum Vitae certified by the local People’s Committee for each applicant aged 16 years or over (no more than 6 months old)
Certified copy of Identity Card for each applicant aged 15 years or over
If previously married, engaged or living in a de-facto relationship - a written statement which clearly states the name(s) and date(s) of birth of previous partner(s), the time period of the relationship and a list of any children born from the relationship(s)
If previously married - certified copies of Divorce Certificate(s) or Death Certificate(s)
Original police certificate of No Criminal Record issued by the local Service of Justice for each applicant (and non-migrating dependent child) aged 16 years or over. Applicants who have lived in any other country for 12 months or more in the last 10 years, must provide police certificates from those countries

If applying for Subclass 309 - Spouse visa:
 Certified copy of Marriage Certificate, if married

If applying for Subclass 300 - Prospective Marriage visa:
A signed and dated letter (on letterhead) from the authorized marriage celebrant in Australia who will conduct the wedding ceremony which clearly states the date and place of the planned marriage ceremony and confirms that a Notice of Intended Marriage (NOIM) has been lodged with the celebrant
An original Single Status Certificate which shows that the applicant is free to marry

Documents relating to the Sponsor:
Two passport size photographs (4cm x 6cm) of the sponsor. Photographs must not be more than 6 months old
Certified copy of the sponsor’s Australian passport, Certificate of Australian citizenship or foreign passport containing evidence of permanent Australian residence
If the sponsor was not born in Australia, a certified copy of the visa used for their initial entry to Australia
Certified copy of the sponsor’s Birth Certificate, or if unavailable, a statutory declaration showing the sponsor’s full name, place and date of birth and full names of parents
 If the sponsor has changed name, a certified copy of the evidence of name change
If previously engaged, married or living in a de-facto relationship - a written statement that clearly identifies the name(s) and date(s) of birth of previous partner(s) and the time period of the relationship and a list of any children born from the relationship(s)
If previously married - certified copies of Divorce Certificate(s) or Death Certificate(s)
If applying for Subclass 300 – A statutory declaration made by the sponsor, before a person authorized to witness a statutory declaration under the Statutory Declarations Act 1959, which clearly states that the sponsor is not married or living in a de-facto relationship with another person and there is no legal impediment to the proposed marriage
Evidence of the sponsor’s capacity to support the applicant(s). This must include certified copies of the last two Notices of Assessment issued by the Australian Taxation Office, evidence of the sponsor’s current employment and income eg. two recent pay slips from their employer and any evidence of savings, investments or ownership of significant assets

Evidence of relationship:
Evidence of relationship MUST be provided at the time the application is lodged. Evidence of relationship includes but is not limited to the following
Statements written by the applicant and sponsor detailing the history of their relationship
Evidence of contact between the applicant and sponsor (eg. letters, telephone bills, emails arranged in date order)
Photos of time spent together and important events e.g. engagements and weddings
Evidence of cohabitation, if any (eg. the sponsor’s temporary residence in Vietnam)
Evidence of joint financial undertakings, if any

Documents relating to Children of the Applicant
Evidence of custody and access arrangements for all children under 18 years of age
A written declaration by the non-migrating natural parent of any child under 18 years of age included in the application, allowing that child to migrate to Australia. The signature of the natural parent and the content of this declaration must be certified by the local authorities. The declaration must be accompanied by a certified copy of that parent’s ID Card and Household Registration Book
Certified copies of Birth Certificates and 4 recent passport size photographs (4cm x 6cm) for each non-migrating child under 18 years
Completed Form 47A - Details of child or other dependant family member aged 18 years or over for each dependent child 18 years or older (whether migrating or not) and evidence to support their claims of dependency
Original Single Status Certificates for each child 18 years or older included in the application
Certified copies of the official Decision on Recognition of a Child Adoption (including a Record of Receipt and Handing-over a Child Adoption, for any adopted children included in the application.
